1. Introduction

The general terms and conditions of sale detailed below govern the contractual relationship between the User (hereafter referred to as You) and the SERECO (SARL RCS Nantes B 404 311 417 00020 - France) 38, rue des Mortiers, 44120 VERTOU – France (hereafter referred to as We) and both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Sereco as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.

2. Ordering

There is only one method in place to put through an order:
- by Internet on our site: http://www.Sereco.fr  24 hours a day and 7 days a week.

3. Product information

Sereco takes great care when putting information online with respect to the essential characteristics of our products, notably with respect to the technical descriptions emanating from our partners and suppliers and the photographs illustrating the products; this however, within the technical limits that exist and with respect for the best standards on the market.

4. Prices

The prices indicated on the Site are in Euros including delivery costs.

Prices are clearly indicated before confirming the order. We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.

5. Availability

Please note that we will honour your order while stock is available.

In the event that one of the products ordered is not in stock, we will contact you in less than 20 days as of your order date to inform you how long it will be before we are able to deliver the product.

If there are certain products that are temporarily unavailable, we manage order througt a FIFO sytem (First in – First Out). If you choose to refuse, we will reimburse the unavailable product.


6. Delivery methods

Your order will be sent under 2 to 3 weeks to the address you indicated when you placed your order.

Sereco does everything in its power to respect the delivery times indicated on the Site. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third-party contracted to make delivery or by you or because of some unforeseen event or an Act of God.

In the event that you do not receive your package in the indicated time-frame, an investigation will be conducted with the carrier and may take several days upon receipt of your claim (20 days average). During this period, no reimbursement or re-delivery will take place.

As of reception of your order, we recommend that you verify your products with the order that you placed with us and indicate if necessary, on the delivery voucher in hand writing with your signature, any anomalies that may have occurred.

Without prejudice with respect to the applicable legal guarantees, we recommend that you address any reservations you may have as it pertains to malfunctioning products on the date of delivery as quickly as possible by Post to the following address:

Returned products can only be accepted for products in their original state, notably with respect to their packaging, accessories and manuals.

In the event of non-conformity of the product purchased, the User will have the possibility to ask for replacement of the product. We would like to inform you that a delay of 5 days is possible for delivery of your order. In fact, for security reasons, all orders paid by bank card are verified by SERECO.

Complimentary information may be requested, or demanded, in order to validate your purchase.
By consequence, and in trying to avoid any delay, please enter as of placing your order:
-a professional or paid-for email address

 We apologise for any inconvenience this may cause, however these measures are taken to protect our clients from possible fraud associated with bank cards.

7. Secure payment

Sereco.fr uses the Crédit Agricole to guarantee the security of your payments.
Sereco has chosen to assure payment security with Crédit Agricole by encrypting the connection when transmitting information on the network.
The name Crédit Agricole may appear on your bank account statement.
Please note that if your security department suspects fraud, we have the right to cancel the transaction for security reasons.

 

Sereco offers 1 method of payment: Credit card (Visa or MasterCard)

 

To pay by credit card, debiting will be made when your order is forwarded on condition that we have received pre-authorisation for your account. If sufficient funds are not available, your order will not be taken into account. For payment made online by credit card, the “Secure Socket Layer” (SSL) system of security is used, which allows for encrypting your banking information when on the network.


8. Right of Retraction - Satisfied or your money back

Sereco allows you 7 working days to return a product that you are not satisfied with. You can return the product within this time period, at your own expense, accompanied by your invoice and a completed and signed return goods voucher.
We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is notably necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility.

Only new and complete (accessories, manuals,...) products will be accepted, returned in their original packaging.

Any product that has been damaged, or not in it’s original packaging, or packaging that has been worn beyond simply opening the product will not be refunded, or may be partially refunded as per the following conditions. It the product is returned incomplete or damaged to Sereco, the product’s value will be discounted according the diagnostic test performed by Sereco’s After Sales Service. Sereco will justify its decision in writing to the customer based on the After Sales Service’s remarks.

The deadlines mentioned above are effective as of the date of reception of the order. This document is necessary, as your return will not be accepted without it.

The right of retraction is exercised without penalty, save for shipping fees.
If tests need to be conducted on the product, in the framework of the right of retraction, Sereco will do its best to reimburse the User as quickly as possible.
The time period depends on the nature of the technical tests performed, by the After Sales Service of the manufacturer on your equipment, for a maximum period of 6 weeks.

9. Returns

Please note that shipping fees are the client’s responsibility except if the product does not conform to the description of said product (the client is responsible for any damage done during shipping of the returned goods).

For the period covered under warranty, the client must return the product to SERECO’S After Sales Service - 38, rue des Mortiers, 44120 VERTOU – France

 

10. Guarantees

All of the products we sell benefit from:
- The legal guarantee of conformity;
- The legal guarantee from hidden flaws;
- The manufacturer’s guarantee for a period defined by the product purchased and the brand. Shipping fees of the products are the customer’s responsibility.

However, if the product does not conform to the product description, shipping fees will be reimbursed to the customer.

Sereco will handle possible repairs with the manufacturers.
Whatever the problem is with your product, you must attach with the defective product, a copy of your invoice, the guarantee (in the box) and the return goods voucher.
Please note, legal guarantees do not apply to repairs for damage caused by external origin (for example, accidents, shocks, fluctuation of electricity etc.) or by the user’s faulty usage of the product.

The manufacturer’s guarantees sold by SERECO do not cover:
-replacement of consumables (batteries)

-the anormal use or non-conforming usage of products. We ask that you consult the user’s manual provided with the products

In all cases, SERECO will not be held responsible in the event that the manufacturer refuses to honour the warranty due to, but not limited to, any of the above noted reasons.


11. Responsibility

This contract is under French laws. Tribunal of Nantes is considered as the unique competent one.

 

Sereco will not be held liable for the non execution of the contract in case of “force majeure”, act of god, and of the poor use and their consequences on the products purchased from our Site.

 

12. Commentary, criticism, communication

Any opinions left by Sereco Users are screened and moderated by the marketing team.
If the comments infringe on the law or are inappropriate (abusive publicity, defamation, insults, out of context commentary…), Sereco reserves the right to refuse it or to modify it.

13. Protection of personal data

Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order.
By registering on the Site, you agree to provide us with sincere and true information as it concerns you.

Communicating false information is contrary to the present General Conditions as well as the conditions of use listed on the Site.
In accordance with the "Data processing and Freedoms" law, the processing of your details was the subject of a declaration made before the CNIL (French data protection watchdog).
Sereco is authorised to extract, handle and use information that concerns you.
This information is the subject of computer processing.

This activity is strictly regulated: The file must be declared to the CNIL.

 

You have the permanent right to access and rectify all the information that concerns you, in accordance with European texts and national laws in place (article 34 of the law of January 6th 1978). You can at any moment make a request to Sereco to find out what personal information they contain for you. You may at any moment, and by request, modify this information.

Only Sereco has information regarding you.

Sereco’s partners have been specially chosen by Sereco and are recognised for the quality of their products and services.
